1. Acceptance of Terms

By accessing flycowboys.io, purchasing a subscription, or using the FlyCowboys application (together, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Educational Purpose and Disclaimers

2.1 Not FAA Approved

flyCowboys is NOT approved, endorsed, or certified by the Federal Aviation Administration (FAA) or any other aviation authority. The content provided is for educational and supplemental study purposes only.

2.2 Not a Substitute for Professional Training

This App does NOT replace:

• Certified flight instruction from authorized flight instructors (CFI)
• Official FAA publications and materials
• Approved Part 61 or Part 141 flight training programs
• FAA knowledge tests or practical tests
• Aircraft flight manuals or pilot operating handbooks

2.3 No Guarantee of Accuracy

While we strive for accuracy, we make no warranties or representations about the accuracy, reliability, completeness, or timeliness of the content. Aviation regulations and procedures change frequently. Always verify information with current official FAA sources.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, flyCOWBOYS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any aviation incident, accident, or violation resulting from use of this App
• Failure of FAA knowledge or practical tests
• Any direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury or property damage of any nature whatsoever

4. Indemnification

You agree to indemnify, defend, and hold harmless flyCowboys, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any FAA regulations or aviation laws
• Any claim that your use of the App caused damage to a third party

5. User Responsibilities

As a user, you acknowledge and agree that:

• You are solely responsible for your aviation training and education
• You will not rely solely on this App for flight training or test preparation
• You will comply with all applicable FAA regulations and aviation laws
• You will verify all information with official sources before application
• You will maintain current and valid certificates and ratings as required

6. Intellectual Property

All content in the App, including text, graphics, logos, and software, is the property of flyCowboys or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit permission.

7. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

8. Subscription and Payments

Premium features require a paid subscription. Web pricing is $29.99 per month or $167.99 per year unless a different price is clearly displayed at checkout. The annual web plan includes a 3-day trial; the monthly plan does not. Stripe collects a payment method at checkout. Unless cancelled before the trial ends, the annual plan automatically renews and Stripe charges the displayed annual price plus applicable taxes.

Subscriptions continue and automatically renew until cancelled. Manage a web subscription through the Stripe billing portal linked from the FlyCowboys app. Manage an App Store subscription through Apple. Cancellation stops future renewal but does not normally end access before the current paid period expires. Refund requests are evaluated under the policy of the provider that processed the purchase and applicable law. Prices, promotions, and taxes shown at checkout control if they differ from this summary.

9. Prohibited Uses

You may not use the App to:

• Violate any laws or regulations
• Impersonate any person or entity
• Interfere with or disrupt the App's operation
• Attempt to gain unauthorized access to any portion of the App
• Use the App for any commercial aviation operations

10. Medical Fitness

This App does not provide medical advice. Users are responsible for maintaining appropriate medical certification as required by the FAA for their flying activities. Consult with an Aviation Medical Examiner (AME) for all medical certification questions.

11. No Professional Relationship

Use of this App does not create any professional relationship, including but not limited to an instructor-student relationship, between you and flyCowboys. We are not responsible for your flight training progress or certification.

12. Third-Party Services

The Service relies on third parties including Stripe for web billing, RevenueCat for subscription recognition, Supabase for authentication and data services, Apple for App Store billing, and Meta for consented advertising measurement. Those providers operate under their own terms and privacy policies. We are not responsible for third-party content or services beyond what applicable law requires.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms in the App. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.

17. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
